Terms of Service

These Terms of Service ("Terms") govern your use of the Suffer More Fitness ("SFRMR") mobile and web application (the "App") operated by Suffer More LLC ("Suffer More", "we", "us", or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (and of legal age in your jurisdiction to enter a binding agreement) to use the App. By using the App, you represent that you meet these requirements.

2. Acceptable Use

You agree not to:

• Use the App for any unlawful or fraudulent purpose.
• Harass, threaten, impersonate, or harm other users, including in community features.
• Reverse-engineer, scrape, or attempt to gain unauthorized access to the App.
• Share or sell your account credentials.
• Upload content you do not own the rights to or that is offensive, defamatory, or illegal.

We may suspend or terminate accounts that violate these rules.

3. Subscriptions & Billing

New accounts get a 14-day free trial of the full app, with no payment details required. Continued access to the full coaching experience is offered through an auto-renewing subscription at $14.99 per month, billed to your payment method through our payment processor, Stripe. If you subscribe, you agree to the following:

• Payment is charged to your chosen payment method at confirmation of purchase.
• The subscription renews automatically every month at the same price unless cancelled before the start of the next billing period.
• Apple App Store (iOS): If you subscribe inside our iOS app, your purchase is processed by Apple through In-App Purchase and billed to your Apple ID. If a free introductory trial is offered, it automatically converts to a paid subscription unless cancelled at least 24 hours before the trial ends. The subscription then auto-renews unless cancelled at least 24 hours before the end of the current period, and you manage or cancel it in Settings → Apple ID → Subscriptions. Refunds for App Store purchases are handled by Apple at reportaproblem.apple.com.
• Web (Stripe): If you subscribe on the web, billing is processed by Stripe. New subscribers may receive a 7-day free trial; if applied, your payment method is charged the monthly price when the trial ends unless you cancel before then. You can manage or cancel at any time via Settings → Manage Subscription in the App, which opens your secure Stripe billing portal.
• For web (Stripe) subscriptions, we offer a 30-day money-back guarantee on your first subscription payment — email support@sfrmr.app within 30 days of your first charge for a full refund. (App Store purchases are refunded by Apple per Apple's policies.)
• After the guarantee period, no refund is provided for the unused portion of a current billing period, except where required by law.
• Pricing may change with prior notice; any change will only take effect at your next renewal.

4. Handmade / Custom Plans (Separate Service)

Personalized, handmade training and nutrition plans created by a human coach are a separate service sold outside the App. They are not included in your in-app subscription and are subject to their own pricing, scope, and delivery terms agreed directly with the coach. Suffer More LLC is not responsible for disputes between you and an independent coach beyond what is explicitly offered inside the App.

5. Not Medical Advice

Content in the App — including training programs, exercise instructions, nutrition suggestions, AI-generated plans, calorie targets, and coach messages — is provided for general fitness and informational purposes only. It is not medical advice and is not a substitute for professional diagnosis or treatment. You should consult a qualified healthcare professional before starting any new exercise or nutrition program, especially if you have a medical condition, are pregnant, or are taking medication. You use the App at your own risk.

6. User Content

You retain ownership of content you submit (e.g. logged workouts, photos, measurements). You grant Suffer More a limited, worldwide, royalty-free license to host, store, display, and process that content solely to operate the App for you. You can delete your content at any time via Account Settings, including by deleting your account.

7. Intellectual Property

The App, including its design, code, training templates, and AI-generated responses, is owned by Suffer More LLC and protected by intellectual property laws. You may use the App for personal, non-commercial use only.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the App will be uninterrupted, error-free, or produce any specific fitness outcome.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUFFER MORE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP — INCLUDING ANY INJURY OR HEALTH ISSUE RESULTING FROM EXERCISE OR NUTRITION ADVICE IN THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

10. Termination

You may stop using the App and delete your account at any time from inside Settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability) will survive termination.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you inside the App and require you to re-accept before continuing.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Suffer More LLC is registered, without regard to conflict-of-law principles.
